Settle for a bodily injury claim?

Unless you have a personal pain and suffering claim, you can only get what you are out of pocket. If your time off work was unpaid, you can typically get paid for that as well as whatever you paid out of pocket for medical. For personal pain and suffering claims however you need to document how this accident has made you suffer VIA a doctor's affidavit testifying to your recurring pain or emotional destress, neither of which you have it appears. The insurance company's only responsibility is to make you whole, as you were prior to the accident... not to compensate you or put you in a better place.
